Statutory Benefits

Mandatory benefits in Baku
Oil and Gas Industry employees: 14.00% wage tax for monthly salaries below 2,500 AZN, 350 AZN + 25% of anything above 2,500 AZN. Private Sector employees: 0.00% wage tax for monthly salaries up to 8,000 AZN, 14.00% of the amount exceeding 8,000 AZN.
Various stipulations for parental rights, including additional time off. Women with two children under 16 get 2 additional days of paid leave; with 3 or more children, 5 days.
Standard probation period is up to 3 months. During this time, either party can cancel the employment agreement with three days’ notice.
Termination of employment must comply with the Employees Act. Notice period varies with length of service, and severance pay is required for redundancy.
Fathers can take 14 days of unpaid paternity leave following the birth of a child.
Standard working hours are no more than 8 hours a day and 40 hours per week, with a five-day working week. Overtime is limited and paid at 200% of the regular salary.
Foreign workers need a work permit from the State Migration Service. It lasts up to one year and must be renewed. Temporary residence permits are initially issued for up to one year.
Employer payroll contributions for the Oil and Gas Industry: 22.00% Social Security, 0.50% Unemployment, 2.00% Mandatory Medical Insurance. The monthly minimum wage is 345 AZN.
Monthly salaries should be divided into two parts and paid twice a month. Annual salaries should be paid not less than once a month.
Minimum Annual Leave entitlement is 21 days, increasing with years of service. Public Holidays: 24 days a year.
Employees are paid in full for the first 14 days of sickness by the employer; thereafter, payments are made by the State Social Protection Fund.
126 days of maternity leave, 70 days before and 56 days after birth. Maternity pay is 100% of the average salary, paid by the State Social Protection Fund.
