The father or partner is entitled to 5 days of paternity leave after the child’s birth, paid at full salary by the employer.
Under certain circumstances, the partner can take over the Maternity Leave entitlement from the mother. Adoptive parents are entitled to eight months of leave.
Employee Income Tax is 10.00% for net annual income between 2,470,644.00 RSD and 4,941,288.00 RSD, and 15.00% for annual income above 4,941,288.00 RSD.
Minimum wage in Serbia is set at 67,566.33 RSD monthly.
The working week in Serbia is typically 40 hours, eight hours per day, five days a week. Overtime is regulated by employment contracts and collective agreements.
Employees are entitled to paid leave during public holidays, which represent approximately 11 days a year.
Employees are entitled to 30 days of paid sick leave compensated by the employer at 65% of the employee’s standard salary. For workplace injuries or sickness, compensation is 100%.
Mothers receive maternity leave for 365 days, extended to 24 months for the third child. Compensation is based on the average salary over the past 1 month and paid by the Government Republic Fund of Health Insurance.
Severance pay is only paid in the case of layoffs. It is equal to at least 1/3 of the monthly average salary for the last 3 months multiplied by the years of service at the company.
Requirements include a valid passport, letter of invitation, application forms, fees, proof of medical insurance, and proof of funds. Employers must complete work permit applications.
Employer Payroll Contributions include 10.00% for Pension and Disability Insurance and 5.15% for Health Insurance. Total Employment Cost is 15.15% + Allowance.
Overtime hours in excess of 40 hours per week are paid at an overtime compensation rate of 126.00% of the employee’s average salary rate. Overtime on public holidays is compensated at 110.00% of the standard rate.
The probation period can be no more than six months. During this time, either party can terminate the employment contract with five days’ notice.
Employees are entitled to 20 days of annual paid leave following the completion of one year of service. Unused days can be carried over until the end of June of the following year.
The termination process varies according to the employment agreement and collective agreement in place. Employers must provide a written explanation at least eight days before termination.
Employers must give an employee eight days notice before dismissal. An employee terminating the contract must provide 15 days’ notice. In the event of layoffs, a 30-day notice period is required.
Employee Payroll Contributions include 14.00% for Pension and Disability Insurance, 5.15% for Health Insurance, and 0.75% for Unemployment Insurance. Total Employee Cost is 19.90%.
In Serbia, the payroll frequency is typically on a monthly basis. Employers must make salary payments at least once a month.
