What is Pay Transparency?

The EU Pay Transparency Directive (Directive (EU) 2023/970) is a binding EU law requiring pay equity for equal work between women and men. It introduces mandatory rules around salary disclosure, pay gap reporting, and worker rights — applying to all EU employers, public and private.

What employers must do in Italy

Before hiring

  • State the initial pay level or pay range for each position in published job vacancy notices
  • Do not ask applicants about current or previous compensation, or obtain it via third parties in recruitment

During employment

  • Use national collective bargaining agreements (NCBAs) as the reference to classify workers and define pay structures and 'work of equal value'
  • Companies with 50+ employees make pay criteria, levels and progression accessible, often by reference to the applicable NCBA
  • Respond to pay information requests within 2 months; employees may request once every 12 months

Reporting and monitoring

  • Gender pay gap reporting is phased by size, starting with organisations of 250+ employees
  • Run a joint pay assessment where an unjustified gap of 5% or more is not corrected within 6 months
  • Penalties set by the decree, with compensation liability under a reversed burden of proof
