Statutory Benefits

Mandatory benefits in Romania
10 days of paid leave, increasing to 15 days for those who participate in an infant care course, available during the first eight weeks after the child’s birth.
Romania has 15 public holidays per year. Holidays falling on weekends are usually lost.
126 days of paid maternity leave. Payment is 85% of the average monthly gross wages of the previous six months.
The minimum statutory monthly gross wage is 4,050 RON.
EU citizens apply for a registration certificate for stays over 90 days. Non-EU citizens need a residency permit. Work permits are required from the Romanian Office for Immigration.
Employer contributions include 2.25% for Unemployment Insurance and 4.00% for Social Security (pension) contribution under special conditions. Total Employment Cost is 6.25%.
Employee contributions include 25.00% for Pension and 10.00% for Health Insurance. Total Employee Cost is 35.00%. Income tax is 0% for 0-5000 RON monthly and 10% above 5,000 RON monthly.
Employees are entitled to up to 180 days of sick leave within one year with a possible 90-day extension. Sick pay varies between 75% to 100% of the average monthly income.
Employees are entitled to up to 20 days of paid annual leave per year. Unused leave must be carried over to the first six months of the following year.
Childcare leave of two months until the child reaches two years of age, with a monthly allowance of 85% of the average regular salary.
Termination can occur by law, mutual consent, or by either party within legal terms. Commonly involves a Mutual Termination Agreement.
Minimum of 20 working days for dismissal. Resignation notice is a maximum of 20 business days for non-management and 45 for management positions.

The work week is limited to no more than five eight-hour days and a maximum of 48 hours per week. Overtime must be compensated with paid hours off or paid at a benefit not lower than 75% of the basic wage.
